Participation Indemnity.
Assumption of Risk and Terms of Participation
Participation is voluntary. These terms explain the risks and responsibilities associated with Club LOJIC activities. Please read them before attending or participating. Participation may indicate acceptance through conduct where legally permitted, following appropriate notice.
Introduction
These Participation Indemnity Terms apply to all individuals attending, participating in, travelling to or otherwise taking part in activities organized, hosted, coordinated, promoted or facilitated by Club LOJIC.
Club LOJIC is an automotive community representing enthusiasts and owners of LEPAS, OMODA, JAECOO, iCAR and CHERY vehicles.
These terms establish the conditions under which individuals participate in Club LOJIC activities and define the responsibilities, risks and limitations of liability associated with such participation.
Scope of Application
These terms apply to all Club LOJIC activities, including but not limited to:
- Organized vehicle convoys and group drives.
- Road trips, excursions and automotive adventures.
- Car meets, car washes and social gatherings.
- Club events, launches, exhibitions and promotional activities.
- Recreational activities, entertainment and outdoor experiences.
- Activities hosted at third-party venues.
- Activities organised in collaboration with sponsors, partners or service providers.
- Informal gatherings officially communicated or coordinated by Club LOJIC.
These terms apply to members, non-members, guests, passengers, drivers, spectators and other participants, subject to applicable law.
Acceptance Through Participation
Participation in any Club LOJIC activity is voluntary.
By knowingly attending, entering, joining or participating in a Club LOJIC activity after these terms have been made available and brought to their attention, a participant indicates acceptance of these terms through their conduct, to the extent permitted by South African law.
No separate electronic checkbox, digital signature or written acceptance is ordinarily required for participation to indicate acceptance.
Participants who do not accept these terms should refrain from participating in the relevant activity.
Where applicable law requires additional acknowledgement or consent for a particular risk or activity, Club LOJIC may require such acknowledgement before permitting participation.
Acknowledgement and Assumption of Risk
Participants acknowledge that automotive and recreational activities involve inherent and sometimes unpredictable risks.
These include, but are not limited to:
- Road traffic collisions and accidents.
- Serious bodily injury, permanent disability or death.
- Vehicle damage, mechanical failure or breakdown.
- Theft, loss or damage to personal belongings.
- Adverse weather and hazardous road conditions.
- Actions or negligence of other road users or participants.
- Pedestrian accidents and incidents at event venues.
- Risks associated with recreational facilities and activities.
- Delays, route changes, cancellations and unforeseen emergencies.
Certain activities may expose participants to unusual hazards or risks capable of causing serious injury or death.
Each participant voluntarily assumes the ordinary and inherent risks associated with their chosen participation, subject to rights and protections that cannot lawfully be excluded.
Indemnity and Limitation of Liability
To the fullest extent permitted by applicable South African law, participants agree that Club LOJIC, its committee members, organizers, volunteers, marshals, representatives, sponsors and associated parties shall not be liable for loss, damage, injury or expense arising from the ordinary and inherent risks of voluntary participation, except where liability cannot lawfully be excluded.
Participants further agree to indemnify Club LOJIC and its representatives against third-party claims, losses and reasonable expenses to the extent directly caused by the participant's unlawful conduct, negligent actions, breach of these terms or damage to another person's property.
This indemnity does not extend to losses caused by the gross negligence, intentional misconduct or unlawful conduct of Club LOJIC or its representatives where exclusion of such liability is prohibited by law.
Nothing in these terms excludes statutory rights, legal duties or liabilities that cannot lawfully be waived or restricted.
Driver and Vehicle Responsibilities
Every participating driver remains individually responsible for:
- Holding a valid driver's license appropriate to the vehicle being operated.
- Ensuring that their vehicle is roadworthy, licensed and legally compliant.
- Maintaining appropriate vehicle insurance where applicable.
- Complying with the National Road Traffic Act and all applicable road regulations.
- Observing speed limits, road signs and traffic signals.
- Maintaining safe following distances.
- Ensuring passengers wear seatbelts.
- Avoiding reckless, negligent or dangerous driving.
- Refraining from driving while impaired by alcohol, drugs, fatigue or any other substance or condition.
Participation in a convoy does not exempt any driver from complying with road traffic laws.
Club LOJIC does not authorize illegal racing, excessive speeding, dangerous maneuvers, obstruction of public roads or any other unlawful conduct.
Convoy Participation
Club LOJIC may appoint convoy leaders, marshals or coordinators to assist with route planning, meeting points and communication.
Their instructions are intended to support orderly and responsible participation and do not replace a driver's independent judgement or legal obligations.
Drivers remain responsible for determining whether any maneuver, instruction or road condition is safe and lawful.
Participants must not attempt to maintain convoy formation where doing so would compromise safety or violate traffic regulations.
Club LOJIC does not guarantee uninterrupted convoy movement, reserved road access or protection from ordinary traffic conditions.
Passengers, Guests and Minors
Drivers are responsible for the lawful and safe transportation of their passengers.
Participants bringing guests must make reasonable efforts to ensure that those guests are informed of the nature of the activity and the applicable participation conditions.
Minors must remain under the supervision of a parent or responsible guardian.
A parent or guardian accompanying a minor is responsible for the minor's supervision and safety, subject to applicable law.
Nothing in these terms is intended to waive a minor's independent legal rights or impose an unenforceable indemnity on their behalf.
Third-Party Venues and Service Providers
Club LOJIC events may take place at restaurants, car washes, entertainment facilities, accommodation establishments, recreational venues and other independently operated locations.
Such venues and providers may maintain their own rules, safety requirements, operating conditions and liability arrangements.
Participants are responsible for complying with applicable venue requirements.
Club LOJIC is not automatically responsible for the independent acts or omissions of third-party service providers, except where responsibility arises under applicable law.
Personal Property and Insurance
Participants are responsible for safeguarding their vehicles, personal belongings, electronic devices and other property.
Club LOJIC does not provide automatic insurance coverage for participating vehicles, passengers or personal property.
Participants are encouraged to maintain suitable vehicle, personal accident, medical and travel insurance according to the nature of their participation.
Any loss, theft or damage will be assessed according to the circumstances and applicable legal responsibilities.
Medical Emergencies
Participants are responsible for considering their own health, physical capabilities and suitability for any activity.
Where an emergency occurs, Club LOJIC representatives may contact emergency services or assist with obtaining appropriate medical attention where reasonably practicable.
Such assistance does not constitute a guarantee of medical services or emergency response times.
Participants remain responsible for medical expenses incurred on their behalf, except where another party is legally responsible.
Conduct and Safety
All participants are expected to behave responsibly and respectfully.
Club LOJIC reserves the right to refuse participation or remove individuals from an activity where their conduct presents a reasonable safety concern, disrupts the event or violates applicable rules.
Prohibited conduct includes dangerous driving, harassment, violence, intentional property damage, unlawful activity and behavior that places others at unreasonable risk.
Removal from an activity does not automatically entitle a participant to reimbursement, subject to applicable consumer protection laws and any specific event terms.
Photography, Videography and Media
Club LOJIC activities may be photographed, filmed or documented for event coverage, community communications and promotional purposes.
Participants should reasonably expect incidental photography and videography at public or organized club events.
Club LOJIC will process identifiable photographs, video footage and related personal information in accordance with applicable privacy laws, including the Protection of Personal Information Act, where applicable.
Participation does not constitute unrestricted consent to every form of commercial use of a participant's image or personal information.
Where separate consent or another lawful basis is required, Club LOJIC will obtain or establish it as appropriate.
Event Changes and Cancellation
Club LOJIC reserves the right to amend routes, schedules, meeting points, activities, venues or event arrangements where reasonably necessary.
Events may be postponed, modified or cancelled due to weather, safety concerns, operational requirements, insufficient participation or circumstances beyond the organizers' reasonable control.
Any applicable refunds or financial obligations will be handled according to the specific event conditions and relevant consumer protection legislation.
No Guarantee of Safety
Club LOJIC may take reasonable measures to promote safe and organized participation.
However, the presence of organizers, marshals, event coordinators or other representatives does not guarantee that an activity will be free from accidents, injury, loss or unforeseen hazards.
Participants are expected to exercise reasonable care and independent judgement throughout their participation.
Application of South African Law
These terms are governed by the laws of the Republic of South Africa.
They must be interpreted consistently with applicable legislation, including the Consumer Protection Act 68 of 2008, where applicable.
Nothing in these terms is intended to exclude liability for gross negligence where prohibited, restrict non-waivable statutory rights or prevent a participant from exercising lawful remedies.
If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permissible.
Amendments
Club LOJIC may update these terms from time to time.
Any revised terms will apply prospectively from their published effective date, subject to applicable law and appropriate notice.
Continued participation after revised terms have been properly communicated may constitute acceptance of those revised terms through conduct, where legally permissible.
Participation Acknowledgement
By voluntarily participating in a Club LOJIC activity after receiving adequate notice of these terms, participants indicate that they:
- Have had a reasonable opportunity to review the participation conditions.
- Understand that participation may involve risks of injury, death, vehicle damage and financial loss.
- Accept responsibility for their own conduct and compliance with applicable laws.
- Understand that Club LOJIC's liability is limited only to the extent permitted by law.
- Agree to comply with reasonable event and safety instructions.
Participation following appropriate disclosure constitutes the participant's indication of acceptance through conduct, to the extent legally recognized.
No separate acceptance checkbox or signature is ordinarily necessary, unless required by law or by the conditions of a particular activity.
